Terms of Service

These Terms of Service (“Terms”) govern your use of the vibe325code platform and marketing website services (“Service”) operated by vibe325code (“we,” “us,” or “our”). By purchasing or using the Service you agree to these Terms in full.

1. The Service

vibe325code provides hosted marketing websites for small businesses. Your site is built from a pre-designed template and populated with content you provide. The Service includes:

• Up to 10 pages per site.
• A custom subdomain (yoursite.vibe325code.com) or your own domain (where configured).
• SSL certificate and global CDN delivery via Cloudflare.
• Mobile-responsive, template-based design.
• Email support.

The Service is template-only. We do not write custom code, create custom designs, or build features outside our pre-built templates. Requests requiring custom development are out of scope and will be declined or referred to NavTech Professional.

2. Pricing and Payment

• The Service costs $550 per year, billed annually.
• Payment is processed by Stripe, Inc. By submitting payment information you agree to Stripe's Terms of Service.
• Subscriptions renew automatically on the anniversary of your start date unless cancelled before the renewal date.
• We offer a 30-day money-back guarantee from your initial purchase date. Refund requests after 30 days are evaluated on a case-by-case basis.

3. Service Limits

The following limits apply per site per subscription period:

• Pages: Maximum 10 pages. Additional pages require an upgrade.
• Traffic: Maximum 50,000 page views per month. Sites that consistently exceed this limit will be notified and offered a higher-tier plan. We reserve the right to suspend sites exceeding this limit after notice.
• Custom code: Not permitted under any circumstances on this plan. Template variants only.

4. Your Content

You are responsible for all content you provide for your site (business name, descriptions, photos, contact information, etc.). You represent and warrant that:

• You own or have the right to use all content you submit.
• Your content does not infringe any third-party intellectual property rights.
• Your content does not violate any applicable law or regulation.
• Your business and website do not involve prohibited industries including but not limited to: adult content, firearms, controlled substances, gambling, financial services requiring licensing, or healthcare services requiring HIPAA compliance.

We reserve the right to remove content or suspend sites that violate these terms without refund.

5. Cancellation

You may cancel your subscription at any time by emailing hello@vibe325code.com. Upon cancellation your site will remain live until the end of the current billing period, after which it will be taken offline. There is no cancellation fee and no long-term contract.

6. Uptime and Support

We make reasonable efforts to maintain site availability but do not guarantee any specific uptime SLA. Scheduled maintenance, Vercel platform incidents, and Cloudflare outages are outside our control.

Support is provided via email at hello@vibe325code.com. Response time is typically within 1 business day. Support is limited to questions about your existing site configuration. Custom development requests will not be addressed under this plan.

7. Intellectual Property

You retain ownership of all content you provide. You grant us a non-exclusive license to host and display that content as part of delivering the Service. The templates, codebase, design system, and platform infrastructure are owned by vibe325code and are not transferred to you. Upon cancellation you are entitled to an export of your content (text and images) upon request.

8. Limitation of Liability

To the maximum extent permitted by law, vibe325code shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid in the 12 months preceding the claim.

9. Modifications to Terms

We may update these Terms as the Service evolves. Material changes will be communicated via email to active subscribers at least 14 days before taking effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
